Welcome to Roomellow (the "Service"). By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. AI-Generated Content Disclaimer

• Designs are conceptual visualizations and should not be used as architectural plans or professional design advice.
• Colors, lighting, proportions, and spatial relationships in generated images may not be 100% accurate.
• AI technology is continuously improving but is not perfect. Results may vary.
• Roomellow is not a substitute for professional interior design, architecture, or construction services.

2. Product Liability Disclaimer

Roomellow displays real furniture products from third-party retailers. We are NOT responsible for:

• Product quality, availability, or pricing: All product information is provided by retailers. Prices, availability, and specifications may change without notice.
• Product purchases: When you click a product link, you will be directed to the retailer's website. Your purchase is governed by the retailer's terms and conditions, not ours.
• Shipping, returns, or customer service: Contact the retailer directly for any issues with your purchase.
• Product accuracy in designs: While we strive to show exact products in generated designs, colors and sizes may appear differently in person than in AI-generated images.

Always verify product details on the retailer's website before purchasing.

3. User Content and Ownership

3.1 Your Content

You retain all ownership rights to images you upload and designs generated from your images. By using Roomellow, you grant us a limited license to:

• Process your uploaded images solely for the purpose of generating room designs
• Store your images and generated designs for your account access
• Display your images and designs back to you through the Service

We do NOT:

• Use your images to train AI models
• Sell your images or designs to third parties
• Share your content publicly without your explicit consent

3.2 Your Responsibilities

You represent and warrant that:

• You own or have the right to upload all images you submit
• Your images do not infringe on any third-party intellectual property rights
• Your images do not contain illegal, offensive, or inappropriate content

4. Payment Terms

4.1 Pricing

Roomellow offers the following pricing tiers:

• Free Tier: 2 free design renders (watermarked)
• Credit Packs: One-time purchases for additional renders (watermark-free)
• Unlimited Monthly: Subscription for unlimited renders (watermark-free)

Current pricing is available on our website and may change with 30 days' notice.

4.2 Payment Processing

Payments are processed securely by Stripe, a third-party payment processor. We do not store your credit card information. By making a purchase, you agree to Stripe's terms of service.

4.3 Refund Policy

Due to the immediate delivery of digital services:

• Credit packs: Non-refundable once purchased (credits are applied immediately)
• Subscriptions: You may cancel anytime. No refunds for partial months. Cancellation takes effect at the end of your billing cycle.
• Technical issues: If you experience a technical error preventing design generation, contact us at support@roomellow.com for assistance or credit restoration.

4.4 Subscription Billing

Monthly subscriptions auto-renew until canceled. You can cancel anytime from your account settings. Cancellation prevents future charges but does not provide a refund for the current billing period.

5. Prohibited Uses

You may NOT use Roomellow to:

• Make high-stakes decisions (construction, real estate transactions, insurance claims) based solely on AI-generated designs
• Upload images you do not own or have permission to use
• Upload images containing illegal content, hate speech, or violence
• Attempt to reverse-engineer, scrape, or copy our AI technology
• Resell or redistribute generated designs as a commercial service
• Use the Service for any unlawful purpose

6. Limitation of Liability

To the fullest extent permitted by law:

• We do NOT guarantee uninterrupted, error-free, or secure service
• We are NOT liable for any damages arising from use of the Service, including but not limited to:
  • Inaccurate designs or product recommendations
  • Purchases made based on generated designs
  • Service downtime or data loss
  • Third-party product or retailer issues
• Our total liability is limited to the amount you paid us in the past 12 months (or $100, whichever is less)

7. Indemnification

You agree to indemnify and hold harmless Roomellow from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your uploaded images infringing on third-party rights
• Your misuse of the Service

8. Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Upload prohibited content

You may delete your account at any time. Upon deletion, your data will be removed within 30 days (see Privacy Policy for details).

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the United States and the state of Texas. Any disputes will be resolved in the courts of Travis County, Texas.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

12. Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or acquirer of Roomellow.
